SUPREME COURT BACKS GENERICS, PAY-TO-DELAY

The U.S. Supreme Court sided with generic drug makers, deciding (in Caraco Pharmaceutical Laboratories v. Novo Nordisk) that generics makers can sue the brand-name innovator, forcing the innovator to correct FDA-filed data the agency uses in approving generic ANDAs. The decision (reversing a lower court finding) says that generics makers may employ Hatch-Waxman Act counterclaim provisions to correct errors in the original coding of the brand’s patent. In another decision, the court refused to consider a Federal Trade Commission-backed challenge (brought by Louisiana Wholesale Drug, in conjunction with CVS and Rite Aid) to a pay-to-delay arrangement for Cipro, between Bayer and generic-maker Barr Laboratories.
